The Duty to Disclose Information Under Article 7:655 of the Dutch Civil Code: A Practical Overview, ArbeidsRecht 2026/9

Section 7:655 of the Dutch Civil Code addresses the duty to provide information at the start of the employment contract and contains a list of essential aspects of the employment contract that the employer must communicate to the employee in writing or electronically.

In practice, this provision is increasingly playing a role in disputes over the interpretation of employment terms and conditions. With the introduction of the Transparent and Predictable Terms of Employment Act (Wtva), the importance of this obligation has increased further: the list of information to be provided has been expanded, the deadlines have been tightened, and case law increasingly invokes (a violation of) the duty to inform. When must an employer take action? What are the risks if the employer fails to inform the employee (in a timely manner)? And what do the Verisure ruling by the Supreme Court from 2024 and more recent case law teach us? In this article, I outline the key points to consider.
