The scope of the prohibition on obstruction under section 9a WAADI, TAP 2019/237
In its 2017 ruling Zzp'er/FOH1 , the Supreme Court interpreted the scope of application of the so-called obstacle prohibition of Section 9a WAADI2 to mean that not only the employee who starts working for the former hirer on the basis of an employment contract can successfully invoke this obstacle prohibition, but also the employee who starts working for the hirer on the basis of an assignment contract.
